Terms of Service

These terms govern your use of ClimbNorth (the “app”, the “service”). By creating an account or using the app, you agree to them. If you do not agree, please do not use the service.

Acceptance of terms

By installing, accessing, or using ClimbNorth you confirm that you are at least 13 years old and that you accept these terms. If you are using the app on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

Description of service

ClimbNorth is a mobile application that helps climbers in Canada track their indoor climbing sessions and discover gyms across the country. The service includes session logging, a directory of verified Canadian gyms, optional social features such as friends and visit history, and account management.

The service is provided as-is and is offered free of charge. Features may be added, changed, or removed at any time.

Account responsibilities

You are responsible for keeping your account credentials confidential and for any activity that occurs under your account. Notify us immediately at climbnorthapp@gmail.com if you suspect unauthorised use.

You agree to provide accurate information when creating your account, and to keep it up to date. One person, one account.

Acceptable use

When using ClimbNorth you agree not to:

  • Use the app to harass, threaten, impersonate, or abuse other users, including through the friend or visits features.
  • Submit content that is unlawful, defamatory, or infringes on someone else’s rights.
  • Attempt to access another user’s account or any non-public part of the service.
  • Reverse-engineer, decompile, or attempt to extract source code, except where permitted by applicable law.
  • Use automated scripts or bots to interact with the service.
  • Submit deliberately false session data, fake gym entries, or spam content.

We reserve the right to suspend or terminate accounts that violate these rules.

Content ownership

You retain ownership of the content you create in ClimbNorth: your sessions, notes, profile data, and uploaded photos. You grant ClimbNorth a limited, non-exclusive licence to store, display, and process that content solely for the purpose of operating the app for you. This licence ends when you delete the content or your account.

ClimbNorth’s gym directory, branding, app code, design, and any aggregate data are owned by us and may not be reproduced without permission.

Service availability

We do our best to keep the service available and working correctly, but we do not guarantee uptime. The service depends on third-party providers (see the privacy policy for the list) and may be interrupted by their outages, by maintenance, or by changes beyond our control.

We may modify, suspend, or discontinue any part of the service at any time, with or without notice.

Termination

You may stop using the service and delete your account at any time. See delete account for instructions.

We may suspend or terminate your account if you violate these terms, if your account is inactive for an extended period, or if continuing to provide the service to you would expose us or other users to legal or operational risk.

Disclaimers and liability limits

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Climbing carries inherent physical risk. ClimbNorth is a tracking tool. It is not a substitute for proper instruction, safety equipment, supervision, or judgement, and we are not responsible for any injury, loss, or damage arising from your climbing activity.

To the maximum extent permitted by law, ClimbNorth and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the service.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute arising from these terms or your use of the service will be brought exclusively in the courts located in Ontario, Canada.

Changes to terms

We may update these terms from time to time. The “last updated” date at the top of the page reflects the most recent change. Material changes will be announced in-app, and continued use of the service after a change takes effect constitutes acceptance of the updated terms.
